This Acceptable Use Policy ("AUP") establishes the rules, standards, and requirements governing the use of the services, products, applications, software, APIs, merchant tools, digital products, websites, platforms, and related offerings provided by EARNMET TECHNOLOGIES PRIVATE LIMITED ("Earnmet", "Company", "we", "our", or "us").
This Policy forms an integral part of the Earnmet Terms and Conditions and applies to all users, customers, merchants, vendors, affiliates, partners, developers, administrators, visitors, and any other individual or entity accessing or using the Earnmet platform ("Users").
The purpose of this Policy is to protect the security, integrity, reputation, reliability, legal compliance, and proper functioning of the Earnmet platform while ensuring a safe and trustworthy environment for all users.
By accessing or using the Services, you agree to comply with this Acceptable Use Policy and all applicable laws and regulations.
1. GENERAL PRINCIPLES
Users may only use the Earnmet platform for lawful, authorized, ethical, and legitimate purposes.
Users shall not engage in any activity that may interfere with the operation of the platform, harm other users, expose Earnmet to legal or regulatory risk, damage Earnmet’s reputation, compromise security, violate applicable laws, or negatively impact the availability, reliability, or performance of the Services.
Earnmet reserves the right to determine, in its sole discretion, whether any activity violates this Policy.
2. COMPLIANCE WITH APPLICABLE LAWS
Users are solely responsible for ensuring that their activities comply with all applicable laws, regulations, governmental requirements, licensing obligations, industry standards, court orders, regulatory directives, and contractual obligations.
The use of Earnmet Services for any activity prohibited by applicable law is strictly forbidden.
Nothing contained within the Services shall be interpreted as permission, authorization, or encouragement to engage in unlawful conduct.
3. PROHIBITED ACTIVITIES
Users shall not use the Earnmet platform to engage in activities that are illegal, fraudulent, deceptive, harmful, abusive, unethical, or otherwise inconsistent with the intended purpose of the Services.
Without limitation, prohibited activities include any conduct involving fraud, identity theft, impersonation, forgery, deception, misrepresentation, unlawful solicitation, money laundering, terrorist financing, sanctions evasion, corruption, bribery, unauthorized financial activities, tax evasion, intellectual property infringement, privacy violations, harassment, stalking, abuse, discrimination, threats, or unlawful surveillance.
Users shall not submit false information, create fictitious accounts, conceal their identity, misrepresent their business operations, falsify documentation, manipulate transactions, or attempt to deceive Earnmet, other users, payment providers, regulatory authorities, or third parties.
Any attempt to circumvent platform safeguards, compliance controls, verification procedures, transaction limits, account restrictions, or security mechanisms shall constitute a violation of this Policy.
4. PROHIBITED PRODUCTS, SERVICES, AND BUSINESS ACTIVITIES
The Earnmet platform may not be used in connection with products, services, transactions, or business activities that violate applicable law or create unacceptable legal, regulatory, financial, reputational, or operational risk.
Without limitation, prohibited activities may include businesses involving counterfeit goods, stolen property, intellectual property violations, unauthorized software distribution, illegal gambling, lottery schemes, betting services, pyramid schemes, Ponzi schemes, fraudulent investment programs, deceptive financial products, unlicensed financial services, unlawful lending activities, fraudulent fundraising campaigns, human trafficking, child exploitation, illegal drugs, narcotics, controlled substances, weapons prohibited by applicable law, forged documents, illegal surveillance equipment, malware distribution, cybercrime tools, hacking services, spam services, phishing operations, or any activity that may facilitate criminal conduct.
Earnmet reserves the right to expand, modify, or update the list of prohibited activities at any time based on legal, regulatory, business, security, or risk considerations.
5. ACCOUNT ABUSE AND PLATFORM MISUSE
Users shall not misuse the platform or attempt to gain unauthorized access to any system, account, network, application, database, server, API, or infrastructure associated with Earnmet.
Prohibited conduct includes attempting to bypass authentication controls, exploiting vulnerabilities, reverse engineering platform components, interfering with service operations, conducting denial-of-service attacks, introducing malicious code, scraping data without authorization, automating unauthorized access, probing security controls, or engaging in any activity that may compromise platform security.
Users shall not use bots, scripts, automated systems, crawlers, or similar technologies in a manner that disrupts or negatively affects the Services unless expressly authorized by Earnmet.
6. FRAUD PREVENTION AND PAYMENT INTEGRITY
Users shall not engage in any activity intended to manipulate, falsify, conceal, disguise, reverse, inflate, misrepresent, or otherwise improperly influence transactions conducted through the platform.
Activities prohibited under this section include transaction laundering, artificial transaction generation, payment manipulation, unauthorized chargebacks, card testing, refund abuse, settlement abuse, collusion, false claims, fake purchases, self-dealing transactions, account sharing for payment purposes, or any attempt to circumvent financial controls.
Earnmet reserves the right to review, monitor, suspend, delay, reject, reverse, or investigate any transaction that appears suspicious or inconsistent with legitimate business activity.
7. ANTI-SPAM AND COMMUNICATIONS
Users shall not use the platform to distribute unsolicited communications, bulk messages, spam, phishing content, deceptive marketing materials, misleading advertisements, malicious links, or unauthorized promotional content.
All communications conducted through the platform must comply with applicable anti-spam laws, privacy laws, telecommunications regulations, and industry standards.
Users remain solely responsible for obtaining any consent required before sending marketing communications to customers, subscribers, prospects, or other recipients.
8. USER CONTENT AND COMMUNITY STANDARDS
Where the Services permit the submission, publication, storage, sharing, or transmission of content, users shall ensure that such content is lawful, accurate, respectful, and appropriate.
Users shall not upload, publish, distribute, or transmit content that is defamatory, abusive, threatening, obscene, misleading, fraudulent, discriminatory, hateful, violent, unlawful, or otherwise objectionable.
Users shall not upload content that infringes the intellectual property rights, privacy rights, publicity rights, contractual rights, or other legal rights of any person or entity.
Earnmet reserves the right to remove content at its discretion without prior notice.
9. INTELLECTUAL PROPERTY RESPECT
Users must respect the intellectual property rights of EarnMet and third parties.
The unauthorized use, reproduction, copying, distribution, modification, sale, licensing, publication, or exploitation of copyrighted materials, trademarks, trade secrets, software, proprietary content, databases, or other protected works is strictly prohibited.
Users shall not use the platform to facilitate intellectual property infringement or unauthorized distribution of protected materials.
10. SECURITY REQUIREMENTS
Users are responsible for maintaining the security of their accounts, devices, credentials, systems, and communications.
Users shall promptly notify Earnmet of any suspected unauthorized access, security incident, data breach, credential compromise, suspicious activity, or misuse affecting their account or the platform.
Failure to maintain reasonable security practices may result in restrictions or suspension where necessary to protect the platform and its users.
11. MONITORING AND ENFORCEMENT
To protect the integrity of the platform, Earnmet reserves the right to monitor usage patterns, investigate reports of misconduct, conduct compliance reviews, assess risk indicators, review submitted information, verify identities, analyze transactions, and take other actions necessary to detect violations of this Policy.
Earnmet is not obligated to actively monitor all user activities but may do so where appropriate or required.
Users acknowledge that Earnmet may cooperate with regulatory authorities, law enforcement agencies, courts, financial institutions, payment providers, and other authorized entities when required by law or when necessary to protect legitimate interests.
12. VIOLATIONS AND CONSEQUENCES
If Earnmet determines that a user has violated this Policy, Earnmet may take any action it deems appropriate.
Such actions may include warnings, content removal, transaction restrictions, account limitations, temporary suspensions, permanent account termination, withholding of settlements, cancellation of services, reporting to authorities, legal proceedings, or any other remedial action permitted by law.
Earnmet shall not be liable for losses resulting from enforcement actions taken in good faith under this Policy.
The severity of enforcement measures shall be determined solely by Earnmet based on the nature, frequency, impact, and risk associated with the violation.
13. MULTI-LANGUAGE PLATFORM DISCLAIMER
Earnmet provides its Services and related policies in multiple languages for the convenience of users.
Certain translated content may be generated, assisted, or supported through automated translation technologies, including but not limited to Google Translate and similar machine translation systems.
While Earnmet seeks to improve accessibility through multilingual support, translated content may contain inaccuracies, omissions, contextual variations, grammatical inconsistencies, or differences in interpretation.
Users acknowledge and agree that translated content is provided solely for convenience. Earnmet does not guarantee the accuracy, completeness, reliability, legal validity, or enforceability of translated versions of this Policy.
In the event of any discrepancy, conflict, inconsistency, ambiguity, or difference between the English-language version of this Policy and any translated version, the English-language version shall prevail and govern.
Earnmet shall not be responsible for any loss, claim, misunderstanding, dispute, liability, or damage arising from reliance upon translated content.
14. MODIFICATIONS TO THIS POLICY
Earnmet reserves the right to modify, amend, replace, update, or revise this Acceptable Use Policy at any time.
Any modifications shall become effective upon publication on the Earnmet platform unless otherwise specified.
Users are responsible for periodically reviewing this Policy to remain informed of current requirements.
Continued use of the Services following publication of revisions constitutes acceptance of the updated Policy.
